Scoleri v. On The Beach – Trial Presentation

On August 24, 2011 we finished a trial with the Cooney, Trybus, Kwavnick, Peets law firm. During the trial, attorney Bruce Trybus used our services to help present the evidence.

  Using Visionary Professional 8.0, we scanned in all his documents and  synchronized all the video depositions to the transcripts. Mr. Trybus had us barcode all the documents and pre-annotate all the documents with highlights and tear-outs. Doing this allowed for him to simply use the barcode reader to instantly bring up the documents onto the projector screen. Not only was he able to bring up the documents, but he could also use the barcodes to bring up the highlights and tear-outs we had made before the trial.

  During the trial, we made video clips from the plaintiffs previous deposition for impeachment(also barcoded). This was very useful for the jury to be able to see the plaintiff during her deposition give a different answer to the proposed question in trial.

 The true power of trial presentation lies in the ability to reach the jurors on multiple levels. Everyone retains information differently and for the jurors to be able to read, see and hear the evidence makes them a part of the presentation and keeps their attention exactly where Mr. Trybus wanted. The plaintiffs had made a dozen or so blow-up boards and had to constantly search through them and drag them out for the jury to see. They also had to point with their fingers to specific portions of the boards to draw attention to what they wanted, compared to our ability to draw the jurors attention onto a projector screen where the documents and images can be zoomed into, highlighted and even redacted at any given moment.

 The case settled two days into trial, but not before Mr. Trybus was able to lay out a strong defense by having the evidence available at the push of button and keeping the jurors attention exactly where he wanted it.

Miami office opening postponed till March

 

Our Miami office opening has been postponed again. We are still under construction and hard at work. Our new tentative date for opening is now March 1st.

Now that the permitting issues are gone, construction has restarted.

We are very excited to be a part of the Miami-Dade legal community and look forward to being your litigation support company. Next week, Legal Video Services will be sending out emails to all South Florida attorneys. The emails will have information about the services that we offer and updates on the construction. For our grand opening, we will be inviting everyone to join us for an open house at our new 19 West Flagler Street office.

Miami Office Opening Moved to February

Toys for Tots Update

There are only a few days until Thanksgiving is here and everyone knows “Black Friday” follows the festive day.  So we at Legal Video Services hope that you will remember to pick-up a gift to bring to our office for The Toys for Tots collection. 

We already have a few toys but look forward to more.  Here are some gift ideas for teens; cologne/perfume, make-up sets, gift sets. These are great gifts because they come wrapped in sets or baskets which can be picked up at the grocery store, pharmacy and shopping centers and everyone goes to at least one of those on a weekly basis, don’t they?

Toys for Tots at Legal Video Services

The Holidays are quickly approaching and the staff at Legal Video Services wanted to do something special for the community. We felt that there is nothing more special than seeing a child smile.  So we contacted the U.S. Marines and are an approved drop-off site for Toys For Tots program.  The Toys For Tots program accepts new, unwrapped items and they don’t necessarily have to be just toys. Keep in mind that teens need smiles, too!   We will be collecting during regular business hours, 9:00-5:00, until December 20, 2010.

So please join the Legal Video Services staff in putting a smile on a child’s face this holiday season! We will be posting updates and gift ideas weekly, so be sure to follow our blog.

Certified Court Video Specialist

Congratulations to Brian Terrinoni, for becoming a Certified Court Video Specialist by The American Guild of Court Videographers. Brian also holds a bachelor’s degree in Media Production from Flagler College in St. Augustine, Florida. With his certification, Brian joins the team of certified legal videographers here at Legal Video Services. We are excited to have a him as a new member of the team!

The CCVS certification is a two day course held by the AGCV. The course is an overview of the proper procedure for setting up, shooting and controlling the quality of a videotaped legal proceeding. The program is very similar to the CLVS certification by the NCRA. At the end of the two days, he was given a 200 question exam to complete the certification and he passed with flying colors.

Brian, now has the training, experience and certification that will uphold the high standards of quality that Legal Video Services is known for.

Certified Multimedia Expert

Congratulations to Russell Coker, Production Manager at Legal Video Services, for becoming a Certified Multimedia Expert through West LiveNote. The certification process was held at West LiveNote’s headquarters in San Francisco, California. With his certification, Legal Video Services will be promoting video streaming using LiveNote Stream and video text sync files that are West LiveNote and Case Notebook ready.

The certification process was a one and a half day, hands-on training class with a written test for certification at the end. The course is filled with valuable information on all of West Livenote software, including LiveNote Stream. LiveNote Stream is a powerful tool that can be used in a deposition and allow for experts, clients and other attorneys to sit in on the deposition without leaving home and only requires a broadband connection. The program allows for participants to watch the depo, read the realtime transcript and instant message to the onsite attorney. The training also teaches you how to create LEF and PTZ files for importing into West LiveNote family of case management software. The real value in the training is fully understanding all the different file formats and how to use them correctly with in the West LiveNote family of software(and training in San Francisco isn’t so bad, either).

CME certification is highly recommended by Legal Video Services for anyone in the legal support field who wants to understand how to better manage their discovery, stay on top of the changing technology and gain experience with West LiveNote software family. Legal Video Services is Coming to Miami!

Opening in January 2011, Legal Video Services will have a brand new second office located at 19 West Flagler Street suite M-104, just feet from the Miami-Dade County Courthouse.

The new office will have two conference rooms. The largest of the two conference rooms is 380 square feet in a boardroom setting and has room for twelve to fourteen individuals. This room will also have HD video conferencing with dual 50 inch flat screen viewing. The second conference room is smaller, but fits up six people comfortably in a deposition setting.

We will have editing and duplication services on-site, but the Fort Lauderdale office will still be our headquarters and will be the site for the majority of our post-production work.

We look forward to the opening and we are very excited to bring our services to Miami!

Understanding Video Formats Used in Legal Video

Many attorneys, paralegals and court reporters do not know what video formats are being used inside the courtroom. Many attorneys will order a DVD without really understanding what a DVD is or what a DVD can do. Simply put, a DVD is just a storage disk and it can be many different things depending on what is stored on it. DVD has pretty much completely taken over as the preferred delivery method for the legal community. A full day of videotaped deposition testimony can now fit on one DVD and be synced to the transcript.

There are two main formats that are delivered on DVD. The first is MPEG-2, the standard video format for making a DVD video disk. This is what an attorney usually means by “I’ll take a DVD.” The DVD video disk is limited, but can make a solid fixed presentation. A well authored DVD can have extensive menus and hours of video, images and graphics. Yet, its limitations are it can not be edited, meaning you need to have your presentation locked in before creating the DVD video disk. This format is useful when trial deposition designations have been agreed upon early in the case, for simple viewing or for making a video settlement brochure.

The second format is called a video text synchronized DVD. This is the format that you see in trial more and more these days. The talking head video with a few lines of text running underneath, precisely synced with the audio. Understanding the tools available on these disks can be a real game changer and money saver. A professionally synced DVD gives the user the ability to make video clips with ease, a simple drag and drop. After making clips the user can then watch the clips in a presentation mode, export the clips for emailing and export video clips directly into PowerPoint. You can also hyper-link exhibits to the transcript for viewing. It’s like an E-Tran on crack, fully search-able and editable video disk that can hold between 6 and 7 hours of good quality MPEG-1 video.

MPEG-1 is the chosen video format for text syncing and trial presentation. The reason is file size. Two hours of MPEG-2 video is over 4 gb, while two hours of MPEG-1 is barely over 1 gb. MPEG-1 encoding is based on saving file size by repeating pixels that do not change or move. This is the reason why MPEG-1 can be used in legal video. Meaning a deposition that will always have very little movement in the video frame can look very sharp when encoded to MPEG-1 by a video professional with professional equipment.

Another important part to these text synced DVDs is that they are ready to be imported to any trial presentation software. Trial Director, Visionary and Sanction are the three main players in the courtroom presentation programs. It is important to let the people handling your video text syncing know if you are using any of these software to manage your discovery. This will allow them to provide you with the correct files for importing into your case management software. You do not have to have case management software to take advantage of these tools, but you will be prepared when it comes time for trial.

Save invaluable trial time by having a witness always available and be able to edit the video “on the fly” when that last minute objection comes in, by having your videotaped depositions synchronized with the transcript. Being prepared is an attorneys best weapon in trial.
